RESERVATIONS: Please visit https:Quiltcations.com for our tours and booking information.  Quiltcations utilizes the independent travel services of Deb Roberts’ Tours.

Minimum Purchase: Any tour or for “GOING YOUR WAY”, A minimum 4 nights hotel are required.

Legal Issues:

Deb Roberts’ Tours has no special unpublished (otherwise something NOT publicly unavailable to you) knowledge regarding the financial condition of any suppliers (airline, cruise ship, hotel/motel, coach company, tour company, ship line) or unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel.

All travel is taken at the risk of the traveler, in other words, your are responsible to keep yourself informed of any unsafe conditions (including government travel warnings), health hazards, weather hazards or climate extremes to any place where you may visit with Deb Roberts’ Tours/World of Quilts Travel and act accordingly.  You are strongly encouraged to contact your health care provider with any concerns you may have.   You travel at your own risk.

By registering for this tour, you agree: I am voluntarily participating in this tour, and as lawful consideration for the agreement to participate I agree not to make a claim against QUILTCATIONS or DEB ROBERTS’ TOURS (Deborah J Roberts LLC), any utilized travel agency or tour suppliers or related companies, officers and employees for injuries, death, illness, loss or any other claim and agree to release QUILTCATIONS/DEB ROBERTS’ TOURS (Deborah J Roberts LLC), all suppliers, related companies, officers and employees from any such claim.  This release is binding on all members of my traveling party that I may book, as well as my and their Estate and heirs and this provision shall be enforceable even after my trip has ended. It is understood that I/we undertake travel at my/our own risk.  I have the permission of anyone I am booking to approve and accept these terms and conditions for them.

SAFETY CONCERNS OR HEALTH RISKS: You are responsible to keep yourself updated regarding any warnings or risks associated with your travel, please see the appropriate Travel.State.Gov website by clicking here.

If you are not a citizen or resident of the USA, please see your country’s health and safety information regarding travel.

CORONAVIRUS-Covid-19:  Please refer to the CDC website for the latest information on coronavirus https://www.cdc.gov/coronavirus/2019-ncov/about/index.html  and at https://travel.state.gov/content/travel/en/traveladvisories/ea/covid-19-information.html.  Each guest will be required to review on this page and by so doing agree to our Covid Waiver and Release (bottom of page) Beginning January 20, 2021, all newly booked guests will be required to have to be up to date with Covid 19 vaccinations and boosters.

Passports and Visas: Passengers living outside of the USA are responsible for ensuring that they have the proper travel documents and MUST CHECK with their respective consulate(s) or visa agency to determine whether any visas or passports are required. Passports are required to be valid for at least 6 months beyond the dates of travel. Some countries require a full blank page in the passport for stamping purposes. Non-US citizens should check with the respective consulate of the country(s) to be visited for current entry requirements.

Travel Protection: Missing a vacation is bad enough. Losing the money you paid for your vacation is even worse. Therefore, we recommend Travel Protection that helps provide coverage for Trip Cancellation, Interruption, Baggage Loss or Delay, Medical Expenses and more. Travel Protection is non-refundable after 10 day free look period. For a summary of the plan details on coverages, benefits, limitations and exclusions, please refer to the Description of Coverage by visiting Quiltcations.com/insurance.  You will be offered the choice of standard travel protection or Cancel For Any Reason (CFAR) travel protection.  CFAR offers you a 75% refund when you cancel for any reason. CFAR must be purchased within 14 days of your tour purchase.

Any questions about what travel insurance does or does not cover should be addressed directly to the travel insurance company. If I decline insurance coverage, I personally assume full responsibility for any financial loss associated with my travel arrangements, and I acknowledge I could lose my travel investment and/or have to pay more money to correct the situation.  Once final payments have been made or the deadline for refunds has passed, I understand that refunds are not possible.  Travel protection is strongly encouraged.

Documents: Provided full payment is received no later than your Final Payment Due date, documents will be sent via email about 21 days prior to the onset of services. We do not send paper documents via the US postal service mail.

Age: All guests on group tours must be over the age of 21.

Prices: Unless stated otherwise, prices are per person based upon shared twin room occupancy or a private room with a single supplement in addition to the shared room price. Prices do not include items of a personal nature such as laundry, wines, water, beverages, food other than the included on itinerary meals, passport and visa fees, insurance, and foreign port taxes unless specifically indicated in the package inclusions. Prices are correct at time of publication; however, prices continually fluctuate, tour package prices and availability may change accordingly if required by the supplier.  This means the price of the tour may go up or down depending on inflation, currency rates, etc.  

Published tours that include airfare will not include the cost of airline taxes and fees which due to frequent fluctuation in price, these will be added on at the time of ticketing.  The charge will be added onto your final payment.

PRICE CHANGES:  We reserve the right to modify the price of any tour at any time if the supplier price to us is altered or changed in any way prior to travel.  Deb Roberts’ Tours or Quiltcations reserves the right to re-invoice for a corrected price or service when the price has been increased by our tour supplier. This will not change your obligation to the tour. Refund requests will be handled as per our cancelation dates and deadlines below, or if your notified: 

Up to 160 days prior to departure: $250 p.p.
159 to 120 days prior to departure: 50% of cost
120 to 90 days prior to departure: 90% of cost
60 days or less prior to departure: 100% of cost

PAYMENT & CANCELLATION:  The following applies to all escorted groups and Going Your Way customized adventures.

Deposit: A non-refundable deposit is due at the time of reservation 
All reservations (except where specified) the deposit is $250 per person.  For Viking River Cruises the deposit is $500 per person, $250 of which is non-refundable.  Travel protection purchases can be made at anytime up until 1 week prior to departure except for Cancel For Any Reason must be purchased within 14 days of your original booking.  The purchase of travel protection (cost of) is not refundable for any reason. 

Installment Payment:  An installment payment of 50% of the balance due will be requested approximately 9 months prior to travel.  You will be invoiced for this payment.  If this payment is not received within 1 week of this date, your trip will be cancelled without refund.

Final Payment:
All reservations (except where specified): The final payment is due 120 days prior to the date the trip commences.

Late Payment: If there is any outstanding balance by the Final Payment Due date listed on your invoice, all travel services will be subject to automatic cancellation and cancellation fees will apply. A service reinstatement fee of $50 will be added to your invoice and must be paid in advance in order to apply for reconfirmation of services.

Last Minute: All reservations made within 120 days of travel must be paid in full within 24 hours of booking. If services are confirmed, final payment is due within 24 hours and all applicable cancellation penalties will apply. If requested services cannot be confirmed, payment will be refunded.

Form of Payment: Bank transfer or credit card to wetravel.com, our booking engine. All payments made within 30 days of departure must be made by credit or debit card.

Refunds: Refunds are processed to the credit card(s) originally used for payment or by check if your payment was a bank transfer.   Refunds will not exceed the total amount paid.

* Travel Protection (Insurance) premiums are paid at booking are not refundable at any time.

Cancellation: Once a partial or full payment has been made, cancellations will only be accepted in writing. Submit your cancellation to “Cancel QUILTCATIONS reservation” in the subject line to debrobertstours@gmail.com. Cancellation terms will be applied based on the date that the written cancellation is opened and based on the following dates prior to departure.  Acknowledgement of receipt will be sent back upon opening a cancellation email.

Cancellation fees apply to packages and/or services as indicated below. Cancellation fees will not be less than the initial non-refundable deposit.

All reservations, except Viking River Cruises and where specified:
Up to 160 days prior to departure: $250 p.p.
159 to 120 days prior to departure: 50% of cost
120 to 90 days prior to departure: 90% of cost
60 days or less prior to departure: 100% of cost

If a tour is announced as a GO or sold out refunds are not possible unless someone can be found to take your place.

Special Events & Products: Deposit, Final Payment, and Cancellation penalties may differ for special events, some customized groups including group tour airfares, tours with internal flights, and/or certain river cruises based on cabin category, length of sailing, and seasonality, as well as select packages and hotels, and will be advised at time of booking on your booking contract.

Reservation Changes: Travelers may utilize the Flexible Change Policy for their first reservation change. All future changes to an existing reservation up to the Final Payment Date, whatever the cause, will incur a $50 per person change fee plus the potential loss of any supplier fees (such as non-refundable event tickets, park permits, and sea cruise reservations) plus any costs for replacement services. On/after the Final Payment Date, the $50 change fee is no longer valid, instead cancellations terms apply.

Changes include the removal of any services such as optional tours and transfers.

*Please note: Replacing a traveling passenger with another traveling passenger constitutes a cancellation, is subject to cancellation penalties, and is not covered by our flexible change policy. Changes or additions after departure are subject to local rates at the time of amendment and if requested must be paid directly by the passenger to the service provider. There are no refunds for unused tickets or services or refunds for funds transferred from one trip to another.

UNFORSEEN CIRCUMSTANCES: I understand that due to unforseen circumstances such as a terrorist events, natural disasters, nuclear reactor contamination, acts of war, civil unrest, travel bulletins or alerts, government prohibitions or regulations, epidemic or pandemic, the possiblity exists that a retreat may be postponed and rescheduled at the discretion of Deb Roberts Tours. Should this happen I accept that unless payment deadline dates are  altered in writing by QuiltCations the original dates for deadlines and penalties on the original tour remain in effect.   Should a retreat be rescheduled, it is not considered to have been canceled.  Should I not wish to participate in a rescheduled retreat, I will notify Deb Roberts Tours/QuiltCations Retreats in writing within 48 hours days of this date change notification whereupon I will receive a full refund.  After 48 hours it will be understood that I still wish to participate and my booking will remain within the context of the new retreat dates and terms and conditions.

 

Travel Protection: I understand that travel protection is encouraged.  Travel protection that includes medical coverage is strongly recommended. During the booking process, I may choose to purchase travel protection as indicated when making my trip option.   Any questions about what travel insurance does or does not cover should be addressed directly to the travel insurance company. If I decline insurance coverage, I personally assume full responsibility for any financial loss associated with my travel arrangements, and I acknowledge I could lose my travel investment and/or have to pay more money to correct the situation.  Once final payments have been made or the deadline for refunds has passed, I understand that refunds are not possible.   I may choose from CFAR (Cancel For Any Reason) or Standard travel protection.  CFAR coverage covers 75% of your trip cost should you cancel for any reason and must be purchased within 14 days of my first deposit.

NOTE:  We are not responsible for the purchase of airfare, even once a trip is confirmed as a go. Purchasing travel protection when you purchase air is strongly encouraged.

TRAVELERS NEEDING SPECIAL ASSISTANCE:

In order to fully enjoy your Deb Roberts’ Tours or Quiltcations tour, we recommend that you select a trip that is suitable to your physical capabilities. Tour participants should review the tour with their health care provider to ascertain ability to travel.  Should a participant require any form of assistance, including travelers with physical disabilities, sight, hearing or mobility impairments, are required to notify Deb Roberts’ Tours or Quiltcations prior to booking a tour. Deb Roberts’ Tours or Quiltcations will review the tour requirements with you to determine the level of assistance you may need and to ensure that the trip you have selected is suitable for you. Please be aware that the Americans with Disabilities Act (ADA) is only applicable within the United States and facilities for disabled individuals are limited outside of US borders. Any participant requiring assistance must be accompanied by a companion who is capable of and fully responsible for providing the assistance. Deb Roberts’ Tours or Quiltcations, tour managers, guides, drivers or other tour, hotel, transfers or ship personnel are not able to provide individual services such as assisting with walking, pushing a wheelchair or helping with getting off and on motor coaches, cruise ships and other vehicles. In order to participate in escorted tours, passengers must be able to understand and follow instructions given by the Tour Director at all times, both for the successful operation of the tour and as well as for their own personal safety and the safety of other participants. Deb Roberts’ Tours or Quiltcations reserves the right to reject participation or remove any individual from a tour in the event that notification was not provided and/or when, in our sole judgment, continued participation would significantly hinder the services to be provided to all guests. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the responsibility of the passenger. All unused services are non-refundable. Escorted tours are fast paced, often requiring lengthy walks over uneven terrain. In the interests of group harmony, clients should be able to maintain the pace of the tour. Clients with special needs may be better served independently. Deb Roberts’ Tours or Quiltcations is happy to offer GOING YOUR WAY, independent travel services or customized family/small group itineraries.

Wheelchairs & Walkers:

USA Tours: Pursuant to the Americans with Disabilities Act (the ADA), Deb Roberts’ Tours or Quiltcations seeks to accommodate disabled travelers to the extent possible and consistent with the specific tour itinerary. Nevertheless, you may find that certain tour features may not be accessible to the extent that you require a wheelchair, scooter, or other special equipment to participate. We cannot provide individual assistance to travelers with wheelchairs or other mobility devices and we regret that some international itineraries without  ADA requirements cannot accommodate certain wheelchairs or motorized scooters. Passengers are required to advise Deb Roberts’ Tours or Quiltcations of their accessibility requirements prior to booking in order for us to determine if reasonable accommodations are available. Deb Roberts’ Tours or Quiltcations will make reasonable efforts to accommodate the special needs of our tour participants but is not responsible in the event it is unable to do so nor responsible for any denial of services by hotels, air carriers, transportation companies, restaurant, sightseeing companies or other independent contractors.

International Tours: Hotels, transportation providers, sea and river cruises outside of the United States are not required to comply with ADA requirements and therefore may not have ramps, wide entryways or elevators/lifts to accommodate disabled passengers or devices such as wheelchairs, walkers and motorized scooters. Due to physical constraints and space limitations, wheelchairs, walkers and motorized scooters may not be taken aboard motor coaches, river cruises or other forms of transportation.

Service Animals: Service animals cannot be accommodated on international escorted tours. Passengers on USA escorted tours who require a service dog because of a disability should check with Deb Roberts’ Tours or Quiltcations prior to booking a tour.

Luggage:  The standard luggage rule for coach travel is 1 bag per person, this is any size bag with or without wheels.   You may also have a small carry on that will fit on your lap, such as a purse or briefcase.

Hotel Accommodations: All rooms are standard twin-bedded (two single beds) rooms with private facilities, unless you have specifically requested and paid for an upgraded room category. Room selection in all cases, unless otherwise reserved, is strictly at the discretion of the hotel’s management on a run-of-house basis. Special requests such as bed types, smoking preference and connecting rooms are subject to availability. Triple rooms consist of standard twin beds or one double bed plus a sofa/folding bed or cot for third person except in the U.S. and Canada, where triple rooms often consist of two double/queen beds for three persons; a fee may be charged by the hotel for the addition of a cot/rollaway. Some single rooms are smaller than a standard room size. The number of persons accommodated does not dictate the room size. Although available at most 4 and 5 star hotels, use of air-conditioning abroad differs greatly from the United States. Many European and Canadian hotels were built before central air-conditioning was introduced. Air-conditioning is often shut down at night and from the end until the start of the summer months. All hotel rates are based on Deb Roberts’ Tours or Quiltcations agreements with its suppliers and are not negotiable. Hotel check-in time is generally not before 4:00 p.m. and check-out time is prior to noon. Please be sure that adequate arrangements for accommodations have been taken into consideration when a late night flight is being used. If a day room is included in the itinerary, check-out will normally be 6:00 p.m. We reserve the right to make substitutions with hotels of equal standard. There will be no refunds for any difference in the cost of those accommodations.

Hotel & Cruise Profiles: Deb Roberts’ Tours or Quiltcations hotel and cruise ship profiles are based upon information provided to Deb Roberts Tours by hotel and cruise ship partners and their representatives, including images and descriptions of individual properties. Star-ratings may differ from country to country.

Meals: As specified in each itinerary, meals are based on the hotel’s or restaurant’s buffet or set menu. In general, beverages are not included, unless specifically stated. Dietary request and preferences should be provided at the time of booking or submitted in writing at least 72 hours prior to departure at debrobertstours@gmail.com. Although Deb Roberts’ Tours or Quiltcations cannot make any guarantees, every effort will be made to honor special dietary requests. Terminology for dietary requests can vary from country to country. Therefore we stronglyrecommend that you make your wishes known to your tour manager upon arrival, and at each hotel/restaurant.

Transfers: Transfers are provided when indicated for a tour by car, minibus, or motor. If transfers are not included, this will be indicated on the “not included” section of the tour’s information website. OR, if you purchase a land-only tour, or if you deviate from the arrival and/or departure dates as stated in the itinerary, transfers will be your responsibility.

Sightseeing & Itinerary: Escorted tours are operated by motor-vehicle, its size dictated by the number of participants. Our have been designed to accommodate individuals as well as groups.  Some itineraries may have early morning start times for sightseeing in order to complete the touring during daylight hours or avoid afternoon heat in tropical and desert climates. It is your responsibility to arrive on time for all scheduled package components. Arriving late may be considered a “no-show”, in which case you will not be eligible for refund for the unused service(s). We cannot guarantee the number of passengers who will be on any given tour. You may find that you are traveling with a sizeable group or only with your own companions. Services, however, will remain constant no matter the number of tour participants. On dates including, but not limited to religious holidays and national celebrations, some monuments and sites may be closed. On these occasions, touring itineraries may be amended to reflect these closures. Occasionally, during holidays and certain periods, and/or due to unforeseen circumstances including weather conditions there may be last-minute changes, sometimes after arrival, affecting the sequence of the tour, locations visited and/or hotels. Therefore, we reserve the right to adjust the sequence and/or substitute any hotels with others of similar category. In such cases there will be no cost adjustment. National monuments and tourist sites regularly undergo renovations, which can obscure the monument’s view. No tour will be canceled due to renovations; however Deb Roberts’ Tours or Quiltcations will decide based on the conditions whether to amend an itinerary. Itineraries may contain suggestions for activities for your leisure time; these suggestions do not constitute an endorsement of any specific service provider and the decision to participate in any such activities should be made independently and with due consideration.

English Language: Escorted tours are conducted in English only and all Tour Managers, local guides and hosts speak English. All commentary and instructions will be provided in English only. For maximum enjoyment and understanding, you must be able to understand, read and speak English.

Optional Sightseeing Tours: A limited selection of optional sightseeing tours may be available for purchase at any time until 30 days prior to departure. Those associated with escorted and guided programs will be available for purchase locally based upon availability. Some optional tours require a minimum number of participants and may not be operated; in such cases, the tour company will attempt to notify you locally, and you will receive a full refund upon your return home. Optional tours may be conducted in more than one language. Optional tours are subject to standard cancellation terms including being fully non-refundable upon purchase.

Non-Operation of Escorted Tour: Our escorted tour packages are based upon a minimum number of participants. We reserve the right to cancel or reschedule any escorted tour or individual booking for any reason including insufficient demand or events beyond our control. Cancellation will be advised at least 45 days prior to the tour’s departure.  The tour may be rescheduled (in which case it is not canceled) or canceled at our discretion.  Refunds will be based on the refund schedule at the time.  Insurance is strongly suggested.  Deb Roberts’ Tours or Quiltcations Travel will not be held responsible for any costs relating to the issuance and/or cancellation travel protection, airline tickets or visa fees. Voluntary cancellations due to political instability, acts of terrorism, government intervention or US State Department warning will be subject to the above cancellation fees.

Group Harmony: To ensure the desired group synergy, Deb Roberts’ Tours or Quiltcations reserves the right to accept, reject or expel any individual who is deemed disruptive or incompatible with the interests of the group, including, but not limited to, (a) if it is reasonably believed that an individual is dangerous to others or to themselves; (b) has engaged in or threatening to engage in behavior that may adversely affect the safety, security, well-being or enjoyment of other individuals; (c) who are intoxicated and/or under the influence of drugs (d) who has failed or refused to follow stated rules and procedures or the instruction of our employees or representatives. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the responsibility of the passenger. All unused services are non-refundable. Deb Roberts’ Tours shall be entitled to recover from the individual any cost or expenses incurred by Deb Roberts’ Tours or its representative in the removal of the individual.

RIVER CRUISES:

Cabin Assignment: Depending upon the vessel, cabin numbers may be assigned at the time of reservation. Assignments are subject to change. We also reserve the right to amend cabin assignments onboard without prior notification. Shore excursions which are not included in the cruise package may only be purchased aboard ship unless an optional tour package is available for advance purchase.

Inability to Sail: Neither Deb Roberts’ Tours nor the owners or operators of the vessels shall be liable for delay or inability to sail or perform due to any condition caused by or arising from water level, inoperable locks, strikes, lockout, civil or labor issues, explosion, fire, collision, vessel breakdown or damage to the vessel, its hull, machinery or fittings. Neither shall they be responsible for issues caused by or arising from civil commotion, riot, insurrection, war, government restraint, requisitioning of the vessel, political disturbance, acts or threats of terrorism, epidemics or the threat thereof, inability to secure or failure of supplies including fuel, Acts of God, or other circumstances beyond their control. In such cases, part or all of the cruise itinerary may be operated by motor coach and accommodations provided by hotels. When the option exists, the operator will “swap ships” with another vessel sailing in the opposite direction. Crew, ship and cabin configuration may differ. If one of these options becomes necessary, Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations Travel will endeavor to provide equal or similar services, however no tour will be canceled and no monetary compensation will be made for those changes.

Terms & Conditions: Terms & Conditions governing the river cruise component of a Tour & Cruise package apply to all customers sailing with each respective cruise company and may be viewed as follows: Viking Cruise Lines. 

Medical Services: Ship’s crew may be able to provide basic first-aid, however ships do not carry a doctor or nurse onboard. Should professional medical attention be required, local services will be contacted upon the passenger’s request and passenger’s expense.

Health Requirements: Check with your healthcare provider for up-to-date requirements. You may also check the Centers for Disease Control (www.cdc.gov) and/or the World Health Organization (http://www.who.int/en/) for their recommendations. Required inoculations, if any, must be recorded by clients’ health practitioner on a valid vaccination certificate which the client must carry for proof of inoculation where required. Individuals with heart disease, chronic illness, physical handicap, advanced pregnancy, or mental illness should not participate in these rigorous travel programs. Any person who arrives to the destination ill with apparent fever or becomes ill during the tour, will be removed from the group and directed to a local medical facility for diagnosis. Only upon written clearance by an accredited medical facility that the guest is able to participate in the remaining activities of the tour will that individual be allowed to resume group travel. All costs associated with medical treatment and related expenses such as additional hotel nights or transportation not included in the original itinerary, will be the responsibility of the passenger. Travel protection plans will only consider coverage with documentation and receipts for services provided by legally qualified health-care facilities, and in accordance with policy terms.

Travel Safety Advice: At Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations we take your safety and security very seriously. We have a strong network of tour managers, local offices, ground operators and colleagues which help us stay informed in all the destinations that we operate. We closely monitor local situations which enable us to make the operational decisions necessary to keep our tours running safely. Millions of people travel the world each year and experience enjoyable and safe trips but crimes against people and property are sadly a fact of life. It is very important to be aware of your surroundings and avoid drawing attention to yourself. Please remember that you have the same responsibility for your personal safety and possessions as you do at home. It is essential to prepare for a safe and healthy travel abroad. Therefore before you travel, we strongly recommend that you visit the website of the US Department of State at https://travel.state.gov/content/travel.html for up-to-date travel advice on the countries that you are visiting if outside of the USA. The website provides useful information on subjects such as safety and security information, health precautions and medications, health insurance and additional tips for traveling abroad. If you do not reside in the United States, we recommend you check your government’s travel advisory website for any country you will be visiting. We recommend that you review the safety guidance that may be provided by us, our agents or suppliers, either before you go or when you arrive in your destination. You can also find helpful tips on our website in the “Trip Preparation” tab of each of our tour packages. We do know that in-spite of careful planning, things can sometimes still go wrong, so rest assured, we will be there to help and support you.

Luggage (Escorted Tours): All Deb Roberts’ Tours or Quiltcations escorted tour buses allow one piece of luggage per person, plus carry-on bag that will fit on your lap. Additional baggage will be subject to a handling charge of $150 per piece. As Deb Roberts’ Tours or Quiltcations/Deb Roberts Tours will not be responsible for loss or damage to luggage and personal belongings, you MUST report any loss or damage immediately at the time of the incident and obtain a written report from the local authority for submission to your insurance provider.

Weapons: Are not permitted on any tour including, but not limited to, firearms, knives, mace, brass knuckles, and other weapons of any type.

Smoking & Illegal Drugs: No Smoking of any kind (medical or recreational) is allowed on any transportation that is exclusively provided by Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations. This includes e-cigarettes, e-cigars or any other smoking device.  Smoking may be allowed in designated areas of hotels.

Tipping: Complete tipping guidelines are provided with final travel documents and on each program’s website presentation, Trip Preparation/At Your Destination section.

Emergency Contact Details: It is recommended that you provide emergency contact details prior to travel. The reason we collect this information is to be able to get in contact with family or friends in the rare case of an emergency.

PASSENGER AGREEMENT: All passengers are required to complete a Passenger Agreement prior to travel and, by so doing, formally accept Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations Travel’s Terms & Conditions, Release from Liability, and and Binding Arbitration Agreement. Passengers booking online will be required to agree to the Passenger Agreement at the time of booking. Travel documents will not be released without a completed Passenger Agreement. Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations reserves the right to cancel bookings and return deposits without a completed Passenger Agreement.

RELEASE FROM LIABILITY: Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations does not own or operate any entity which is to or does provide goods or services for your trip including, for example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional excursions or equipment used thereon, food service or entertainment providers, etc. All such persons and entities are independent contractors. Independent contractors may utilize the Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations logo on signage or uniforms solely for identification purposes which does not signify Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations ownership, management or control. As a result, Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party. Without limitation, Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, diseases and dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as swimming, kayaking, sailing, canoeing, rafting, hiking, walking, bicycling, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics or the threat thereof or for any other cause beyond the direct control of Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations. In addition, I release Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations from its own negligence and assume all risk thereof.

ASSUMPTION OF RISK: I am aware that travel such as that I am undertaking involves hazardous activities, with a risk of illness, injury or death which may be caused by forces of nature, animals, insects or flora, the negligence of Deb Roberts’ Tours or Quiltcations, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. I am aware that weather conditions may be severe, adverse and/or unpleasant. I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which I am participating on the trip. In order to partake of the enjoyment and excitement of this trip I am willing to accept the risks and uncertainty involved as being an integral part of my adventure. I hereby accept and assume full responsibility for any and all risks of illness, injury or death and of the negligence of Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations and agree to hold harmless and release Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations from claims of third party negligence.

I understand the physical requirements of the activity in which I will be participating, and I currently have no known physical, medical or mental condition which would impair my ability to participate in this tour or my safety in this activity, and I am willing to assume all risks that may be created, directly or indirectly, by any such condition. I hereby authorize Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations or my local groundhandler or others to arrange for any emergency medical treatment and hospitalization as may be necessary for me because of participation in this activity without my further consent.

BINDING ARBITRATION: I agree that any dispute concerning, relating or referring to this Agreement, the brochure or any other literature concerning my trip, or the trip itself, shall be resolved exclusively by binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. §§1-16, pursuant to the Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). Such proceedings will be governed by substantive (but not procedural) California law and will take place in Sacramento, CA. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable. By agreeing to these terms and conditions, you (and we) are waiving our right to a trial by jury.

VOLUNTARY PARTICIPATION: I acknowledge that I have voluntarily applied to participate on the trip designated on this application (or a trip which I may change to) and that I have read the description of the trip as it appears in the current Deb Roberts’ Tours or Quiltcations website and supplements or brochures or website relating to the trip, together with all information contained in this application. I am voluntarily participating in this trip with knowledge of the hazards involved.

KNOWING AND VOLUNTARY EXECUTION: I have carefully read these Terms and Conditions and the booking information sections of this document, and fully understand its contents and certify that I am 21 years of age or older. I am aware that this is a release of liability and a contract between myself and Deb Roberts’ Tours or Quiltcations and agree of my own free will. I acknowledge that I am traveling at my own risk and by registering for any tour constitutes my agreement. By checking the Passenger Agreement box, I agree to these Travel Terms & Conditions and Deb Roberts Tours or Deb Roberts’ Tours or Quiltcations’s Release from Liability, Assumption of Risk and Binding Arbitration Clause for myself, each member of my traveling party.

PHOTOGRAPHIC RELEASE:  Deb Roberts’ Tours or Quiltcations may take photographs or video of its trips and trip participants grant Deb Roberts’ Tours or Quiltcations permission to do so and for it to use same for promotional or commercial use without payment of any compensation to participant.

Covid 19 Waiver and Release of Liability

By utilizing the services of Deb Roberts’ Tours with any supplier (Deb Roberts’ Tours, cruise line, hotel, coach company, train line, etc.) I understand I am accepting and undertaking travel at my own risk. I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in any cruise or tour I have booked along with scheduled events.  I understand and I am willing to undertake any added expenses related to any untoward event (accident, illness, etc.) happening to me during my travels. Insurance is strongly recommended.
 

Due to the ongoing COVID-19 pandemic, I acknowledge and fully understand that for my safety, travel arrangements may be changed, interrupted or cancelled by the supplier, a government entity, or another third party that is outside of Deb Roberts’ Tours control for reasons that are unforeseeable at this time.

I also understand and will agree to supplier’s (Deb Roberts’ Tours, cruise line, hotel, airline, coach company, etc.)health rules and regulations regarding Covid 19, (which may change on a daily basis) including vaccinations, isolation and mask wearing.  If I do not I may be banned from group participation without reciprocation. 

I also understand and acknowledge that travel involves the risk of a variety of hazards to health and/or safety, including but not limited to, injury, death, illness, disease, epidemics, and/or pandemics. I expressly understand and agree that I assume all such risks associated with travel whether or not specified herein. I further understand and acknowledge that Deb Roberts’ Tours/Quiltcations has no control over the associated supplier’s policies.

I also understand and acknowledge that the purchase of travel insurance has been recommended and that coverage for circumstances such as these depends on the specific policy I purchase. Should I elect to obtain coverage, the travel insurance policy obtained by me to cover these travel arrangements will dictate any coverage for financial loss resulting from these circumstances.  I understand I should check with the Travel Insurer with any questions I may have about coverage.   

I understand a PCR or antigen Covid 19 test may be required for travel to or from our tour country and I will take the responsibility to learn which test is needed and deadlines for taking it at my own expense.   Deb Roberts Tours assumes no responsibility for any Covid 19 pre or post travel test information.

If traveling on a cruise, it is each travelers responsibility to check on any cancellation or credit programs a cruise line may be offering due to Covid 19 and deadlines for same.

Each land tour participant (not cruise guests) is required to bring  at least one (1) antigen Covid test kit that includes two (2) covid tests with them. It is the responsibility of each guest to take a covid test when symptomatic and quarantine at their own expense should their test be positive. Participation with the group or continuation  on the tour will not be possible (no refunds provided – insurance is strongly encouraged to cover such medical issues and additional expenses to isolate).  I understand should I become ill or injured I am responsible for separate accommodations and staying in place until I am recovered to return home.

As such, either in the past or in the present, by booking a tour or cruise with Deb Roberts’ Tours I hereby agree to hold Deb Roberts’ Tours/World of Quilts Travel harmless and release it from any and all liability for any damages including, without limitation, monetary losses, damage to person or property, illness/disease/death, delays, negligence, or inconvenience, that I may incur as a result of the circumstances described herein.  

Until further notice a mask will be required on coaches during coach travel together.
